Gaming arcade licence
Service description
If you want to operate an amusement arcade or a business that serves to set up gaming machines with the possibility of winning or to organise other games, you need a permit.
Procedure
- You submit an application to the competent regulatory authority of the responsible municipality or city.
- You submit the required evidence.
- The competent regulatory authority decides on the granting of the licence.
Responsible office
The municipal council is the competent authority for issuing licences in accordance with the HSpielhG as well as monitoring and enforcing this law, in particular taking action against illegal gaming facilities (Section 11 (1) HSpielhG). Which municipality is responsible depends on where the arcade is to be built.
Prerequisites
In accordance with Section 2 (1) HSpielhG, an application is a prerequisite for the granting of a gaming hall licence. The necessary evidence must be provided by the applicant in the form of suitable presentations, concepts and certificates and submitted together with the application.
Which documents are required?
- Informal application for a gaming arcade licence
- Information from the central trade register
- Extract from the commercial register of the country in which the company's head office is located;
- Translation, if applicable. Translation of the extract from the commercial register
- Information from the Federal Central Register (certificate of good conduct)
- Valid identity card or passport (with current registration certificate)
- Certificate on tax matters from the responsible tax office
- Lease, purchase or rental agreement as well as the floor plan of the commercially used premises
- Permission to install gaming machines with the possibility of winning (in accordance with Section 33c (1) of the German Trade Regulation Act (GewO))
- Confirmation of the suitability of the installation location of a gaming device (in accordance with Section 33c (3) GewO)

What fees are incurred?
Prepayment: NoThe fee is charged in accordance with the Administrative Cost Regulations for the Ministry of the Interior and Sport (VwKostO-MdIS) and may amount to a minimum of EUR 222.00 and a maximum of EUR 5,500.What deadlines do I have to observe?
An application for a gaming arcade licence can be submitted at any time, provided the requirements are met.
A licence is limited to a maximum duration of 15 years.

The processing time varies from authorisation authority to authorisation authority. Please enquire with your competent authority.
Legal basis
What else should I know?
A licence may be subject to an ancillary provision or condition.
If necessary, the competent authority will demand payment of an advance on costs (in accordance with Section 16 of the Hessian Administrative Costs Act (HVwKostG)).
