Commercial passenger transport - Authorisation
Service description
The paid or commercial transport of passengers by motor vehicle is subject to authorisation. This section takes a closer look at occasional transport by motor vehicle, which differs from scheduled transport by motor vehicle.
Forms of occasional transport are:
- Transport by taxi,
- Excursions and holiday destination trips by car and motor coach (KOM),
- Transport with hire cars and hire buses.
Authorisation may only be granted if the following requirements are met:
- The safety and efficiency of the company must be guaranteed.
- The applicant or the person entrusted with the management of the business must be reliable.
- The applicant or the person entrusted with the management of the business must be professionally qualified.
- The applicant must have its registered office or branch within the meaning of commercial law in Germany.
Which documents are required?
- Application (form is available on the website of the responsible regional council):
Extract from the commercial or co-operative register, if a corresponding entry exists - Proof of authorisation to represent
- Certificate of good conduct
- Information from the central trade register for the owner and legal representatives
- Proof of financial capacity by submitting clearance certificates from the tax office, the municipality, the social insurance institution and the employers' liability insurance association, the key dates of which must not be more than 3 months in the past at the time of application, as well as equity certificates, if applicable with additional certificates, the key dates of which must not be more than one year in the past at the time of application
- Proof of professional aptitude

- Possible shareholder agreement
If a person has been appointed to manage the business, additional documents must be submitted for this person:
- Proof of the employment relationship
- Certificate of good conduct
- Information from the central trade register
- Proof of professional aptitude

The certificate of good conduct and the information from the central trade register must not be older than 3 months.

What fees are incurred?
The fee is charged in accordance with the Ordinance on Costs for Official Acts in Paid or Commercial Passenger Transport by Motor Vehicle (PBefGKostV). The amount depends on the administrative costs and the value of the subject of the official act.
What deadlines do I have to observe?
Authorisation is granted for a maximum period of 5 years.
