Driving ban and withdrawal of driving licence
Service description
A driving ban and the withdrawal of a driving licence following a criminal conviction have different implications.
A driving ban of between one and six months may be imposed if the (more stringent) conditions for the withdrawal of a driving licence are not met. The period of the driving ban begins once the judgement becomes final, as soon as the driving licence is taken into official custody, but no later than one month after the judgement becomes final. Once the driving ban has expired, the driving licence is automatically returned or sent back.
Where a court revokes a driving licence, the right to drive a motor vehicle ceases as soon as the judgement becomes final, and the driving licence is subsequently withdrawn.
If you want to drive again in the future, you must apply for a new driving licence. The driving licence can only be reissued after the expiry of a suspension period, which the court sets in the judgement. The road traffic authority decides on the reissue of the licence in accordance with the provisions of the StVG and the FeV.
