Exceptions and authorisations in traffic

    Setting up a work/construction site on a public road is a special use requiring authorisation. This requires an order under traffic law and/or a special permit and a special use permit under road law
    Authorisation is required for e.g.

    • Construction sites in general (demolition work, structural and civil engineering work, pipework)
    • Construction trailer or crew/equipment sheds
    • Construction fence
    • Material store
    • Scaffolding
    • Skips and containers
    • Lifting platforms
    • Mobile crane, construction crane, inclined lift or cherry picker
    • Removals

    Information on setting up cranes:

    When using public traffic areas to set up construction cranes or mobile cranes, you must consult the relevant utility companies before using the area.

    This is because only the respective utility company can judge whether the lines possibly running in the area to be used can withstand the load or whether important work or repairs are to be carried out.

    The amount of charges for the use of public roads is subject to a scale and depends on the type and duration of use.
    The fee ranges from 10.20 euros to 767.00 euros.

    To ensure that your application is processed on time, it must be submitted at least 2 weeks before the planned start of road use

Who should I contact?

Within the local thoroughfares, the municipalities are also responsible for federal, state and district roads (§ 17 Hessian Road Act - HStrG -, § 4 Para. 1 Federal Trunk Roads Act - FStrG -).
Outside the local thoroughfares, the Hessen Mobil field offices are responsible. For reasons of administrative simplification, no separate authorisation from the competent road construction authority is required in cases where a permit for excessive road use or an exemption permit is required under the provisions of road traffic law (cf. Section 16 Para. 7 HStrG, Section 8 Para. 6 FStrG).
The authorisation is granted by the road traffic authority with the involvement of the police, the civil engineering department and, if necessary, other authorities.
