Conversion of a civil partnership into a marriage
Service description
People living in a registered civil partnership can convert this into a marriage from 1 October 2017. To do so, the civil partners must declare in person and in the presence of a registrar that they wish to marry for life. If the civil partners have not yet had a joint civil partnership name, they can choose a married name as part of the marriage.
Procedure
The civil partners concerned register the intended conversion of their civil partnership into a marriage with the relevant registry office.
To register the marriage, both partners usually go to the relevant registry office together. If one of the two partners is unable to attend, they can authorise the other partner in writing. The registry office requires the written authorisation of the unavailable partner.
If both are prevented from doing so for an important reason, they can also register the conversion in writing or through an authorised representative.
Prerequisites
The two partners must live in a registered civil partnership and declare to a registrar in person and in the presence of each other that they wish to marry for life.
Which documents are required?
- valid identity card or passport
- Certificate of residence from the registration office
- if the birth was notarised in Germany: certified extract from the (electronic) register of births or certified copy from the register of births
- if the birth was notarised abroad: current birth certificate
If the existing civil partnership was not established at the registry office that is to receive the declaration of conversion, the civil partners must also submit a civil partnership certificate or a printout from the civil partnership register.

What else should I know?
The rights and obligations of civil partners are determined by the date on which the civil partnership was established, even after the civil partnership has been converted into a marriage.
