Service description
All facilities within the scope of the Hessian Building Code must be arranged, erected, modified and maintained in such a way that public safety and order, in particular life, health or the natural foundations of life, are not jeopardised.
This obligation is initially incumbent on the owner or user of the property or facility.The other "parties involved in the construction", such as planners, site managers, contractors and authorised certifiers or experts, also have various monitoring obligations during the planning and construction period.
Authorised inspectors and experts must issue certificates and submit them to the building supervisory authority.The building supervisory authority checks compliance with public law regulations and requirements, as well as the fulfilment of the obligations of those involved in the construction, at its own discretion depending on the degree of difficulty and importance of the facility. In the case of special buildings, recurring safety inspections are generally ordered in the building permit at certain intervals, unless these are already stipulated in the special building regulations.
Inspections
The tasks of the building supervisory authority also include identifying illegal construction activities and uses, i.e. measures for which the required building permit has not been applied for or has not yet been granted. Before the building supervisory authority takes repressive action, it will first request building documents in order to be able to check the material permissibility of the project. This does not apply in the event of imminent danger.
These "illegal buildings" are identified on the basis of our own research, but also on the basis of information from other offices, authorities or neighbours.
What fees are incurred?
A fee is set for the time spent on the inspections. This also includes the time required for preparation and follow-up work in the office and travelling time. Fees ranging from 40.00 euros to 3,200.00 euros are provided for repressive intervention or the request for building documents.
