    The aim of monument protection is to largely preserve the original building fabric and the historical appearance of cultural monuments. You therefore require a licence under monument protection law for construction work on cultural monuments.*

    In addition to individual buildings, entire structures whose appearance is of particular public interest are also protected. This applies above all to streetscapes, squares and townscapes.

    If you intend to make changes to the protected image of an entire complex, you require the authorisation of the lower monument protection authority.

  • Procedure

    For construction projects for which you require a building permit, you must submit a building application to the lower building supervisory authority. Together with this application, you must also submit the completed survey form for the statistics on construction activity.

    The building supervisory authority will involve the monument protection authority on your behalf as part of the authorisation procedure. Depending on the location of the building project, the lower building supervisory authority is the municipal/city administration or the district office.

    If you do not require a building permit, you must apply in writing to the lower monument protection authority for a licence under monument protection law. Depending on the location of the building project, the lower monument protection authority is the municipal/city administration or the district office.

    The monument protection authority consults the municipality concerned before making its decision.

    Note: The monument protection authorities weigh up all affected interests and decide at their own discretion.

  • Prerequisites

    The prerequisites for granting authorisation are

    • the change only insignificantly or temporarily impairs the appearance of the overall installation or
    • overriding reasons of public interest must be taken into account.
  • Which documents are required?

    Depending on the individual case, you will need to submit different documents, for example

    • Site plan of the property
    • Planning documents (floor plans, views, sections) of the property
    • Detailed description of measures with material specifications and construction details or
    • Preliminary investigations and expert opinions from specialised experts (e.g. from the fields of restoration, carpentry restoration, statics, geology)
    • Survey form for statistics on construction activity in building construction (building permit - construction backlog - building completion or demolition - demolition - change of use) in duplicate

    Tip: Contact the lower monument protection authority at an early stage. They will tell you which documents are required for your authorisation procedure.

  • What fees are incurred?

    If a building permit is required, fees will be charged. Please enquire directly with the relevant authority.

  • What deadlines do I have to observe?

    There are no statutory deadlines within which you must apply for authorisation. However, you may only start the construction work once you have the authorisation. This also applies in cases where you do not require planning permission.
