Urban land-use planning

Urban land-use planning is a central instrument of municipal urban planning. It serves to control the urban development of a municipality. The aim is to ensure orderly urban development that meets the needs of the population and the legal framework.


Two stages of urban land-use planning

The urban land-use planning is carried out in two stages.

  1. Preparatory urban land-use plan (land-use plan)
  2. Binding urban land-use plan (development plan)


Legal background and purpose

Urban land-use planning is regulated in the Federal Building Code (BauGB). Sections 1-13 are particularly important, the purpose of which is to ensure sustainable urban development, protect nature and the environment, organise the settlement structure and avoid conflicts of use (e.g. between industrial and residential areas).

The land use plan (preparatory land-use plan) presents the planned urban development of the entire city in outline. It depicts the main features of land use (e.g. residential areas, commercial areas, traffic areas, green spaces) and shows, for example, where residential, commercial or green spaces are planned for the future. The land utilisation plan serves as a preparatory planning instrument and forms the basis for the subsequent development plans.

For the 75 municipalities in the Frankfurt/Rhine-Main conurbation, this is regulated by the Regional Land Use Plan (RegFNP) for Southern Hesse. The RegFNP is currently being revised for the target year 2030.

The development plan (binding land-use plan) specifically regulates how individual plots of land may be used and built on - for example by specifying the type of building use, the extent of building use, the construction method, etc. It is legally binding and implements the specifications of the land-use plan in detail. Participation in urban land-use planning

Interested parties and those responsible sit around a table with a plan in the middle and engage in dialogue.
Participation of citizens

An important part of urban land-use planning is the participation of the public and public agencies. § Section 3 BauGB provides for "public participation" in the urban land-use planning process in order to inform the public about the planning. The public can get involved during the planning process and is invited to submit comments on the planning in order to express concerns and/or make suggestions.

The involvement of the public together with the participation of the authorities in accordance with Section 4 BauGB forms the basis for a comprehensive weighing of private and public interests, which is ultimately decided by the city council.

Two-stage participation

As a rule, participation is in two stages.

  • The first stage is early participation
  • The second stage is formal participation (interpretation).

Depending on the project, there are also simplified procedures in which early participation can be dispensed with.

Information and participation

During participation, there is the opportunity to view the planning documents of the current development plans in the town hall or online. The documents provided are for information purposes only. In the case of major projects, an information event may also be planned, which will be announced in the events calendar .

  • by letter in writing
  • by recording on site at the town hall
  • via the "Bauleitplanung Online" platform on the Internet

Development plan D 32 "Extension of the school on Claus-von-Stauffenberg-Straße"

Early involvement of the public in accordance with Section 3 (1) of the German Building Code (BauGB) and the public interest organisations in accordance with Section 4 (1) BauGB

At its meeting on 11 December 2023, the municipal council of the city of Rodgau resolved the following

  • the preparation of the Dudenhofen development plan no. 32 "Extension of the school on Claus-von-Stauffenberg-Straße",
  • the early involvement of the public in accordance with § 3 (1) BauGB and
  • the early involvement of the authorities and other public agencies in accordance with Section 4 (1) BauGB


The spatial scope of the development plan encompasses parcels 56, 57, 58, 59, 60/1, 61/1, 62/1, 63/1, 64/3, 64/5, 65/1, 66/1, 67/1, 259/1 in part (traffic area) and 260 of parcel 4, Dudenhofen district. The boundaries of the area of application are shown in the following illustration.

General objectives and purposes

The aim of the development plan is to create the legal planning conditions for the further development of a school site.

Early public participation in accordance with § 3 (1) BauGB

The preliminary draft of the development plan, including its textual provisions, explanatory statement, environmental report, climate expertise, species protection report and the preliminary extract of the report on the compensation of the soil as a protected asset, will be published on" he.bauleitplanung-online.de" from 23 March 2026 up to and including 20 April 2026 .

Statements can

  • electronically via the "he.bauleitplanung-online.de" portal
  • submitted in writing to the magistrate of the city of Rodgau during the disclosure period
  • be submitted to the city administration for recording.


In addition to publication on the Internet, the aforementioned documents can be inspected during general office hours at Rodgau Town Hall, Hintergasse 15, 1st floor, room 1.8 in 63110 Rodgau.

Development plan D24 - "Residential area - Hinter dem Dell"

Early public participation in accordance with Section 3 (1) of the German Building Code for the Dudenhofen development plan no. 24 "Residential area - Hinter dem Dell"

On 23 February 2026, the municipal council of the city of Rodgau approved the preliminary draft of the Dudenhofen development plan no. 24 "Residential area - Hinter dem Dell" and the participation of the public in accordance with Section 3 (1) BauGB and the participation of the authorities and other public bodies in accordance with Section 4 (1) BauGB.

The spatial scope of the development plan has changed as follows since the decision to draw up the plan.

  • The current area of application comprises the following parcels of land in parcel 4, Dudenhofen district: 202,

203, 204, 205, 206, 207/1, 207/2, 208/1, 208/2, 209, 210, 211/1, 255/8, 255/9, 255/10, 261/1, 262, 263/2 - 263/3 and 60/2 in part

  • The parcels 104/3, 104/4, 105/2, 106/2, 107/2, 143/3 and 255/2 are excluded from the area of application
  • The parcels 60/2, 61/2, 62/2, 63/2, 64/4, 64/6, 65/2 and 67/2, which are a future extension of

D24 are currently no longer part of the development plan.
